These Terms of Service govern your access to and use of Duetly, including the Duetly mobile application, website, features, content, and related services.
Duetly is operated by CodesOrbit.
By downloading, accessing, or using Duetly, you agree to these Terms. If you do not agree, do not use the application or related services.
1. Eligibility
You must be legally permitted to use Duetly under the laws applicable to you.
If you are below the age required to enter into a binding agreement, you may use Duetly only with permission and supervision from a parent or legal guardian.
2. Duetly Service
Duetly enables supported devices to record video using front and back cameras, select available recording layouts, save content, and export or share videos.
Features may vary depending on:
- Device model
- Camera capabilities
- Operating-system version
- Region
- App version
- Subscription or purchase status
- Technical limitations
CodesOrbit does not guarantee that every feature will be available on every device.
3. Device Permissions
Duetly may require permission to access:
- Camera
- Microphone
- Photos
- Media library
- Device storage
- Other features required for app functionality
Users may manage permissions through their device settings. Certain features may not function when required permissions are disabled.
4. User Content
“User Content” includes videos, audio, images, captions, or other material created, imported, processed, saved, or shared using Duetly.
Users retain ownership of their User Content. CodesOrbit does not claim ownership of videos created by users.
Users are solely responsible for:
- Content they record
- People they record
- Permissions and consents
- Copyright and intellectual-property rights
- Privacy rights
- Publicity rights
- Laws relating to surveillance or recording
- Content they publish or share
- Backing up important files
Users must not record another person unlawfully or without consent where consent is required.
Duetly does not grant users permission to record people, property, performances, music, events, or copyrighted material.
5. Acceptable Use
Users must not use Duetly to:
- Violate applicable law
- Invade another person’s privacy
- Record people unlawfully
- Harass, threaten, abuse, stalk, or exploit others
- Create or distribute unlawful content
- Infringe copyrights, trademarks, or other rights
- Distribute malware or harmful code
- Attempt to interfere with the application
- Reverse engineer the application where prohibited
- Circumvent subscriptions, payments, restrictions, or security controls
- Misrepresent affiliation with Duetly or CodesOrbit
- Use the service for fraudulent or deceptive activity
CodesOrbit may restrict or terminate access where misuse is identified.
6. Safety and Responsible Recording
Users must use Duetly safely and responsibly.
Do not use Duetly while driving, operating machinery, crossing roads, participating in dangerous activities, or in any situation where using a phone could create a safety risk.
Users are responsible for complying with venue rules, event restrictions, privacy laws, and local recording laws.
7. Intellectual Property
Duetly, including its:
- Name
- Logo
- App icon
- Interface
- Graphics
- Website
- Software
- Source code
- Design
- Text
- Features
- Branding
is owned by or licensed to CodesOrbit and is protected by applicable intellectual-property laws.
These Terms provide a limited, personal, revocable, non-exclusive, non-transferable licence to use Duetly for lawful personal or authorised business purposes.
Users may not copy, sell, sublicense, distribute, modify, or commercially exploit Duetly except where expressly permitted.
8. App Store Terms
Duetly may be downloaded through Apple’s App Store.
Users acknowledge that:
- These Terms are between the user and CodesOrbit, not Apple
- Apple is not responsible for Duetly or its content
- Apple has no obligation to provide maintenance or support
- Apple may be a third-party beneficiary of these Terms where applicable
- Use of Duetly must comply with the App Store’s applicable rules
If a conflict exists between these Terms and mandatory App Store terms, the mandatory App Store terms will apply.
9. Purchases and Subscriptions
Duetly may offer:
- Paid downloads
- In-app purchases
- One-time purchases
- Subscriptions
- Free trials
- Promotional access
All payments made through the App Store are processed by Apple.
Prices, billing periods, available products, and trial terms will be displayed before purchase.
Subscriptions may renew automatically unless cancelled through the user’s Apple account settings before the renewal date.
CodesOrbit cannot directly cancel an App Store subscription on behalf of a user.
Refund requests for App Store purchases are generally handled according to Apple’s refund process and applicable law.
10. Free Trials and Promotions
Any free trial, promotional access, discount, coupon, or special offer may be subject to additional conditions.
CodesOrbit may modify or withdraw promotions where legally permitted.
Users may not create multiple accounts, manipulate purchases, or misuse promotions to obtain unauthorised access.
11. Availability and Updates
CodesOrbit may:
- Update Duetly
- Add features
- Remove features
- Modify layouts
- Fix errors
- Change device support
- Suspend parts of the service
- Discontinue the application
Duetly may be unavailable due to maintenance, technical problems, device limitations, third-party services, or circumstances outside CodesOrbit’s control.
CodesOrbit does not guarantee uninterrupted or error-free operation.
12. Exported and Shared Content
When users export or share a video, it may be handled by:
- The device operating system
- Social-media applications
- Messaging applications
- Cloud-storage providers
- Other third-party services
Users are responsible for reviewing the privacy settings, content policies, and terms of any third-party service used to share content.
CodesOrbit is not responsible for content after it has been exported or shared through another service.
13. Third-Party Services
Duetly may depend on or link to third-party platforms, software, SDKs, or services.
CodesOrbit is not responsible for:
- Third-party availability
- Third-party policies
- External content
- Data handling by third parties
- Changes made by Apple or other providers
- Loss caused by a third-party service
Use of third-party services may be governed by additional terms.
14. Feedback
Users may voluntarily provide ideas, suggestions, or feedback.
By providing feedback, users allow CodesOrbit to use it without restriction or compensation for the purpose of improving, developing, or promoting Duetly.
This does not transfer ownership of the user’s separately created video content.
15. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Duetly is provided on an “as is” and “as available” basis.
CodesOrbit does not guarantee that:
- Duetly will always be available
- Every recording will save successfully
- Videos will never be lost or corrupted
- Every device will support every feature
- The application will be free from bugs
- The application will meet every user requirement
- Third-party sharing services will function correctly
Users should keep backups of important content.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
16. Limitation of Liability
To the maximum extent permitted by applicable law, CodesOrbit will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the use of Duetly.
This includes, where legally permitted:
- Lost recordings
- Lost files
- Lost profits
- Lost opportunities
- Device issues
- Third-party claims
- Unauthorised recording
- Content published by users
- Reliance on app availability
Where liability cannot be excluded, it will be limited to the minimum amount permitted by applicable law.
Nothing in these Terms limits liability that cannot legally be limited.
17. Indemnification
To the extent permitted by law, users agree to defend, indemnify, and hold harmless CodesOrbit and its personnel from claims, losses, liabilities, damages, and expenses arising from:
- Unlawful use of Duetly
- User Content
- Violation of another person’s rights
- Unlawful recording or publication
- Breach of these Terms
- Misuse of third-party services
18. Suspension and Termination
CodesOrbit may suspend, restrict, or terminate access to Duetly where reasonably necessary because of:
- Violation of these Terms
- Fraud
- Abuse
- Security risks
- Legal requirements
- Harm to users or third parties
- Discontinuation of the service
Users may stop using Duetly at any time by uninstalling it and cancelling any active subscription through Apple.
Termination does not automatically cancel an App Store subscription unless the user cancels it through Apple.
19. Changes to These Terms
CodesOrbit may update these Terms when Duetly’s features, business model, legal requirements, or third-party services change.
The revised Terms will be posted with an updated effective date.
Continued use after the updated Terms become effective constitutes acceptance where permitted by law.
20. Governing Law
These Terms are governed by applicable laws, subject to any mandatory consumer-protection rights available in the user’s country or region.
21. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
The unenforceable provision will be interpreted or modified only to the extent necessary to make it enforceable where permitted.
22. Entire Agreement
These Terms, together with the Privacy Policy and any additional purchase or feature-specific terms, form the agreement relating to use of Duetly.
